Is it legal to sell a flat with tenants?
Selling a rented flat is an absolutely legal process, quite common and more frequent than it may seem, however, this type of operation has some peculiarities that must be taken into account.
How is the tenant informed of the new situation?
The communication must be made in writing and in an irrefutable manner. It must contain: the sale price, the expected date and the conditions set. My tenant has already waived the right of first refusal in the lease.
Is this clause valid, and do I have to inform him of it in this case?
The clause in a lease contract waiving the right of first refusal is perfectly valid, however, in our experience and to avoid problems at the Notary's office, it is always advisable to have a document of express waiver from the tenant.
What is the right of first refusal and what are the requirements?
It is the right that every tenant has to keep the property under the same conditions that you have set for the rest of the buyers. As the owner, you must inform the tenant in a reliable manner of your intention to sell and the conditions set for the sale. The tenant has 30 days to inform you of their decision.
What will happen to my tenants once I sell the flat?
The existing rental contract must be respected, i.e. the buyer will be subrogated to all the rights and obligations of the contract. The tenants have nothing to worry about, they will continue to pay the same amount and under the same conditions, they will just change ‘landlord’.
What if my tenants refuse to allow visitors?
Your tenant is not obliged to allow viewings, so empathy and a left hand in this case are very important (that's our job). In our experience, our investors are looking for profitability, most of the deals we sign are done without viewings, which is why a good photographic report and a good virtual tour is so important to avoid unnecessary hassle.
